These Terms of Use govern your access to and use of the MYA Boat Charters website, booking system, online services, communications, and related content.

For purposes of these Terms, "MYA Boat Charters," "we," "us," and "our" refer to MYA Boat Charters and any related business names, website names, or brands used on our website, including Seaside Miami Boat Charters where applicable.
By using our website, submitting a booking request, making a payment, confirming a reservation, or communicating with us about our services, you agree to these Terms of Use.
If you do not agree with these Terms of Use, please do not use our website or services.
Relationship to Our Policies and Guidelines
These Terms of Use work together with our Policies & Guidelines, booking confirmations, checkout terms, waivers, written agreements, and any service-specific instructions provided to you.
By confirming a booking with us, you agree to follow all applicable policies, safety rules, payment terms, cancellation terms, weather terms, guest guidelines, and instructions related to your charter.
If there is a conflict between these Terms of Use and a more specific written booking confirmation, signed agreement, waiver, or service-specific policy, the more specific document will control for that booking.
About Our Services
MYA Boat Charters provides private boat charter information, booking assistance, reservation coordination, and related boating services.
Information on our website is provided for general informational and booking purposes. Charter details, availability, pricing, schedules, inclusions, restrictions, routes, amenities, and policies are displayed on our website and are subject to confirmation at the time of booking.
We reserve the right to update, modify, cancel, reschedule, or refuse a booking when necessary due to safety, availability, weather, operational requirements, payment issues, legal requirements, or other circumstances affecting the service.
Website Use
You agree to use our website only for lawful purposes and in a manner that does not interfere with the operation, security, or availability of the website.
You agree not to:
- Use the website for fraudulent, illegal, or unauthorized purposes
- Attempt to gain unauthorized access to our systems
- Interfere with website functionality, security, or availability
- Submit false, misleading, incomplete, or inaccurate information
- Copy, scrape, reproduce, or misuse website content without permission

Bookings and Reservations
Bookings must be submitted and confirmed through our website or authorized booking system.
MYA Boat Charters may communicate with guests by email, phone, text message, WhatsApp, or other communication methods for customer service, trip coordination, questions, arrival instructions, schedule updates, or booking support. However, these communications do not create or confirm a reservation unless the booking is completed and confirmed through our website or authorized booking system.
A reservation is not guaranteed until it has been properly submitted through the website or booking system, accepted or confirmed by MYA Boat Charters, and any required payment has been received.
All bookings are subject to availability, scheduling, payment requirements, weather conditions, safety conditions, operational requirements, vessel availability, captain availability, and applicable laws or regulations.
You are responsible for providing accurate booking information, including your name, email address, number of guests, requested date and time, selected service, and any special requests or relevant trip information.
Informal messages, phone conversations, email discussions, quotes, availability checks, or customer service communications do not hold or confirm a reservation unless the booking is completed through the authorized booking process.
Pricing, Taxes, Captain Service Fee, and Fuel Surcharge
Prices are displayed on our website and during the booking process.
The online reservation payment covers the vessel reservation amount and applicable taxes, unless otherwise stated during the booking process.
As part of our private charter booking structure, the captain service fee and fuel surcharge are disclosed separately from the online reservation payment and are paid separately according to the booking details provided to you.
The captain service fee and fuel surcharge are not hidden charges. They are disclosed before booking so you can review the full amount due in connection with your charter before confirming your reservation.
Where applicable, the captain is selected, engaged, and paid separately by the charterer according to the booking details and applicable charter requirements.
The fuel surcharge is disclosed separately and paid according to the booking instructions provided to you.
You are responsible for reviewing the booking details before confirming your reservation, including the online reservation payment, applicable taxes, captain service fee, fuel surcharge, and any amount due separately.
Payments made through our website may be processed securely through Stripe or another approved payment processor.
MYA Boat Charters does not intentionally store full credit card numbers or complete payment card details on our own website systems. Payment processing is handled by the payment processor according to its own terms, privacy policy, and security practices.
Once a booking is confirmed, the pricing terms shown in your booking confirmation apply to that reservation, unless changes are requested by you or required due to safety, weather, operational, or legal circumstances.
Captain Service Fee and Fuel Surcharge
The captain service fee and fuel surcharge are separate from the online reservation payment.
These amounts are disclosed during the booking process and must be paid separately according to the instructions provided before or at the time of your charter.
For charters structured with a separately engaged captain, the charterer is responsible for selecting and paying the captain according to the booking details and applicable charter requirements.
MYA Boat Charters may provide booking information, coordination assistance, or captain-related instructions, but the captain service fee remains separate from the online vessel reservation payment unless otherwise stated in writing.
The fuel surcharge is disclosed separately as part of the charter’s fuel-related cost and must be paid according to the instructions provided for your booking.
You are responsible for reviewing all booking details so you understand what is paid online and what, if anything, is due separately before departure.
Captain Selection
For charters that require a separately retained captain, the Primary Guest or charterer is responsible for selecting a qualified captain.
MYA Boat Charters may provide information or recommendations for qualified captains for convenience, but the Primary Guest or charterer is responsible for choosing the captain for the charter.
The captain must hold the credentials, experience, and qualifications required for the vessel and charter. The captain has final authority over vessel operation, safety decisions, route changes, weather decisions, passenger conduct, and whether the trip may proceed.
Cancellations and Refunds
Cancellations made at least 24 hours before the scheduled departure time qualify for a full refund.
Cancellations made within 24 hours of the scheduled departure time are non-refundable, unless otherwise approved by MYA Boat Charters or required by applicable law.
Guests who fail to arrive for their booking without prior communication will be treated as no-shows and will not be eligible for a refund.
If a trip is canceled before departure due to unsafe weather conditions, guests may reschedule to another available date or receive a full refund.
Refunds are processed back to the original form of payment. Processing times may vary depending on your bank, card issuer, or payment provider.
Unexpected emergencies may be reviewed on a case-by-case basis. While our standard policies still apply, we encourage guests to contact us as soon as possible if an emergency affects their booking.
Weather Policy
The safety and comfort of our guests is a priority.
Weather conditions may change throughout the day, so the final evaluation of weather conditions is typically made at or near the time of departure.
If conditions are determined to be unsafe or unsuitable for departure, guests may reschedule to another available date or receive a full refund.
If conditions are safe but not ideal, such as light or moderate rain, the trip may still be able to proceed. In those situations, guests may choose whether to proceed, reschedule to another available date, or receive a refund according to our weather policy.
If weather conditions change during the trip, guests may choose to continue or return early, provided conditions remain safe. Light rain or scattered showers do not automatically cancel a trip.
If a trip returns early due to changing weather conditions, refund or credit options may be based on the unused portion of the trip and the circumstances at the time.
Final safety decisions are made by MYA Boat Charters in consultation with the captain or vessel operator.
Rescheduling
We try to accommodate rescheduling requests whenever possible.
If you notify us in advance that you need to change your trip, we may reschedule your charter at no additional charge, subject to availability.
Change requests made less than 24 hours before the scheduled departure time are not guaranteed and may be considered at our discretion.
If you fail to arrive on time, miss your trip, or do not provide enough notice for us to adjust operations, rescheduling may be denied or may require a rescheduling fee.
Rescheduling is always subject to availability, operational requirements, vessel availability, captain availability, and weather conditions.
Arrival Time and Late Arrivals
Guests should arrive 15 minutes before the scheduled departure time to allow time for check-in, boarding, and safety instructions.
Trips begin and end according to the scheduled booking time.
If you arrive late, you may still be allowed to board, but your trip will end at the originally scheduled return time. Lost time due to late arrival is non-refundable.
If arrival is significantly delayed and there is not enough time to safely complete the trip, the charter may not take place and the booking may be treated as a no-show.
If you expect a delay, you should contact us as soon as possible. Adjustments cannot be guaranteed, but advance notice gives us the best opportunity to assist when operations allow.
No-Shows
Failure to arrive for your scheduled trip without prior communication is classified as a no-show.
No-shows are not eligible for refunds.
Rescheduling after a no-show is strictly subject to availability and may require payment of a rescheduling fee.
Guest Count, Maximum Capacity, Age Requirement, and Identification
The maximum capacity is 10 passengers, including children and infants.
No more than 10 passengers may board the vessel. This limit applies regardless of age, size, or whether a passenger is participating for the full trip or only part of the trip.
At least one passenger must be 18 years of age or older.
The Primary Guest listed on the reservation must present a valid government-issued photo ID at check-in.
You are responsible for providing an accurate guest count at the time of booking and for making sure your group does not exceed the maximum passenger limit.
If your group arrives with more than 10 passengers, the additional passengers will not be allowed to board.
If the group refuses to proceed without the additional passengers, causes delays, disrupts operations, or makes it impossible for the charter to depart safely, legally, or on schedule, MYA Boat Charters may cancel the trip and the booking may be treated as a guest violation, late cancellation, or no-show. In that situation, the booking may be non-refundable.
No exceptions to the maximum passenger limit can be made at the dock. Any questions about guest count must be resolved before the scheduled departure time.
Guest Conduct and Safety Rules
You and your guests agree to follow all safety instructions, vessel rules, marina rules, captain instructions, crew instructions, and applicable laws.
Guests are expected to act responsibly at all times.
Unsafe, disruptive, disrespectful, threatening, intoxicated, illegal, or destructive behavior may result in refusal of service, early termination of the trip, removal from the vessel, or cancellation without refund.
The captain or vessel operator has final authority regarding safety decisions, vessel operation, passenger conduct, route changes, and whether a trip may proceed.
Vessel Rules and Prohibited Items
Guests must follow all vessel rules provided before or during the charter.
Unless otherwise approved in writing:
- Shoes must be removed before boarding and placed in the designated area.
- Sunscreen should be applied before boarding to help protect vessel seating and surfaces.
- Smoking is not permitted onboard.
- Vaping may be allowed only in designated areas.
- Red wine is prohibited due to the risk of permanent stains.
- Open flames, spark candles, and similar items are prohibited onboard.
- Balloons and glitter are prohibited due to environmental and cleanup concerns.
- Weapons, controlled substances, hazardous materials, and flammable materials are prohibited.
MYA Boat Charters, the captain, crew, or vessel operator may refuse or remove any item that creates a safety, legal, environmental, cleaning, or property damage concern.
Food, Drinks, Alcohol, and Personal Items
Guests may bring food, snacks, and drinks where permitted, subject to vessel rules, marina rules, and applicable law.
Alcohol must be consumed responsibly and only by persons legally permitted to consume it.
Illegal substances are strictly prohibited.
MYA Boat Charters is not responsible for lost, stolen, damaged, or misplaced personal items.
Guests are responsible for removing their belongings at the end of the trip.
Damage, Cleaning, and Additional Charges
You may be responsible for damage, excessive cleaning, missing items, fines, penalties, or additional costs caused by you or your guests.
Additional charges may apply for damage to the vessel, equipment, property, marina facilities, or third-party property, as well as excessive cleaning, late return caused by guest conduct, or violation of vessel or marina rules.
Accessibility, Health, and Medical Conditions
Boarding may require stepping onto the vessel from the dock. Not all vessels, docks, or marine facilities are wheelchair accessible.
Guests who require assistance boarding, disembarking, or moving around the vessel should be accompanied by someone able to assist them safely.
Guests with mobility limitations, back problems, heart conditions, pregnancy, serious medical concerns, allergies, or other conditions that may affect participation should consult a medical professional before booking or participating.
Children are welcome but must be supervised by an adult at all times.
Guests are responsible for notifying MYA Boat Charters in advance of any condition, limitation, or special need that may affect safety or participation.
Service Animals and Pets
Service animals are welcome where required by applicable law and safety conditions.
Well-behaved pets may be permitted when approved and must remain under the owner’s supervision at all times.
Guests are responsible for any cleaning, damage, disruption, or safety issue caused by their pets.
Assumption of Risk
Boating, water activities, boarding, disembarking, walking on docks, moving around a vessel, and participating in a charter involve inherent risks.
These risks may include, but are not limited to, slips, falls, vessel movement, waves, wakes, weather changes, sun exposure, dehydration, seasickness, marine life, equipment issues, dock conditions, and other risks associated with boating and outdoor activities.
By booking or participating in a charter, you acknowledge and accept these risks for yourself and your guests.
Third-Party Services and Providers
MYA Boat Charters may use third-party providers to support certain parts of our website and business operations, including website hosting, booking, scheduling, payment processing, website security, analytics, technical support, and public review display or authorized review integrations.
Bookings may be managed through LatePoint or similar booking technology. Payments may be processed through Stripe or similar payment processors.
Customer communication and reputation management are handled directly by MYA Boat Charters.
Some services may also involve captains, crew, vessel owners, marinas, contractors, or other service providers involved in fulfilling your booking.
We are not responsible for third-party websites, platforms, policies, systems, downtime, errors, or independent actions outside our control.
Reviews, Testimonials, and User Submissions
If you submit a review, testimonial, comment, photo, message, or other feedback directly to MYA Boat Charters, you grant us permission to use, reproduce, display, edit for length or formatting, and publish that content for business, marketing, website, and promotional purposes, unless otherwise prohibited by law or agreed in writing.
We may also display public reviews, ratings, and testimonials from third-party review platforms or authorized review integrations, subject to the terms and policies of those platforms.
MYA Boat Charters manages its customer feedback and business reputation internally.
You agree not to submit false, misleading, defamatory, illegal, offensive, or infringing content.
Website Content and Intellectual Property
All website content, including text, images, graphics, logos, designs, videos, layout, branding, and other materials, is owned by MYA Boat Charters or used with permission, unless otherwise stated.

To the fullest extent permitted by law, our total liability for any claim related to a booking or service will not exceed the amount paid by you to MYA Boat Charters for the specific booking giving rise to the claim.
